Medical Malpractice | Cerebral Palsy

Cerebral Palsy, also known as "CP," is a non-progressive disorder of posture and movement. Cerebral Palsy is the result of an injury to the brain, typically occurring before, during, or immediately following birth. The most common cause of Cerebral Palsy is a lack of oxygen to the brain. This lack of oxygen can injure the child’s cerebrum and disrupt the brain’s ability to control posture and movement.

There are four recognized types of Cerebral Palsy

  • With Spastic Cerebral Palsy, the muscles are in a constant state of involuntary reflex.
  • Athetoid cerebral palsy involves slow and uncontrolled movements.
  • Ataxic cerebral palsy is the most rare form of Cerebral Palsy.
  • Mixed cerebral palsy is the most common form of Cerebral Palsy. This typically involves a combination of spasticity and athetoid movements.

Cerebral Palsy is often associated with epilepsy and abnormalities of speech, vision, or intellect. These injuries occur as a result of a trauma or injury to the developing brain, often at the time of delivery. Estimates of its prevalence range from two to four cases per 1,000 births. Studies indicate that the lifetime cost of caring for child with a Cerebral Palsy brain injury may exceed $3,000,000.

Only a careful examination of the medical records of both the mother and the child, along with examining the fetal monitor strips which record the heart beat of the baby, can enable one to determine whether an infant suffered oxygen deprivation which caused his or her brain injury. The Law Office of Piercy J. Stakelum have successfully recovered damages for many Florida infants who suffered an injury due to medical negligence during the birth process.
